1. Introduction
Welcome to Project 130 (“we”, “our”, “us”). By downloading, accessing, or using the Project 130 app, website, or related services (“Services”), you agree to these Terms and Conditions (“Terms”). If you do not agree, please do not use the Services.
These Terms form a binding legal agreement between you and Project 130 Pty Ltd.
2. Eligibility & Age Requirements
You must be 18 years or older to create an account or receive cryptocurrency payouts.
Users aged 13–17 may use the app with verified parental or guardian consent.
By using the Services, you confirm that you meet these requirements.
3. Accounts and Registration
You must register with a valid email address and accurate personal details.
You are responsible for maintaining confidentiality of login credentials.
Notify us immediately of any unauthorised access to your account.
We may suspend or close accounts that provide false information or breach these Terms.
4. Membership Tiers and Payments
Project 130 offers two membership tiers:
Tier 1 – Free Membership
Provides access to core features and allows members to earn $0.02 per completed habit.
Tier 2 – Premium (Full Access AI)
Costs $50 AUD per year (payable in either cash or the equivalent value in Qoin).
Includes advanced AI features and triple earnings, allowing members to earn $0.04 per completed habit.
Payments are processed securely via Stripe (for cash payments) or Qoin wallet transfer (for cryptocurrency payments).
Premium memberships renew automatically each year unless cancelled.
You may cancel at any time before renewal, and access continues until the end of the current paid period.
Refunds are only available where required by law.
5. Earning and Reward System
Rewards are granted for verified habit completions recorded within the app.
Each completed habit earns the set Qoin value depending on membership tier.
Rewards have no guaranteed cash value and may fluctuate based on Qoin’s market value.
Fraudulent or automated completions may lead to forfeiture of earnings and account closure.
Minimum payout threshold applies (e.g. $10 AUD equivalent in Qoin).
6. Referrals
You receive a Qoin or cash reward when a referred user successfully completes onboarding.
Unlimited referrals are permitted, but duplicate or fake accounts are prohibited.
7. Marketplace and Affiliate Links
The Marketplace offers products through third-party retailers.
Purchases may earn us a commission but do not affect your price.
We are not responsible for product quality, delivery, or returns handled by third-party sellers.
8. AI Health Coach and Medical Limitations
The AI coach provides educational and informational content only.
It is not medical advice and should not replace consultation with a licensed professional.
We do not diagnose, treat, or cure any medical condition.
Always consult your doctor before changing diet, exercise, or medication.
9. User Content and Community Conduct
You are responsible for all content you upload, post, or share.
You agree not to post:
• Hate speech, harassment, or violence
• Health misinformation or spam
• Copyrighted materials without permission
• Nudity or obscene material
We may remove content or suspend accounts that violate these rules.
You retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free licence to display it within the app.
10. Cryptocurrency and Financial Disclaimer
Rewards are paid in Qoin, a cryptocurrency managed independently of Project 130.
Cryptocurrency values can fluctuate significantly.
We make no guarantees of future earnings or exchange value.
Users are solely responsible for complying with local cryptocurrency laws and tax reporting.
11. Payouts and Tax Responsibilities
Payouts are processed within 7–14 business days after approval.
Identity verification may be required for payouts exceeding regulatory limits.
All taxes, duties, or fees resulting from payouts are your responsibility.
12. Termination and Suspension
We may suspend or terminate your account if you:
• Violate these Terms or applicable laws
• Engage in fraud, abuse, or manipulation of rewards
• Post harmful or illegal content
If terminated for fraud, all unpaid rewards may be forfeited.
13. Intellectual Property
All trademarks, logos, graphics, and software are owned or licensed by Project 130 Pty Ltd.
You may not copy, modify, or distribute any content without written consent.
14. Data Protection and Privacy
We collect and use personal data in accordance with our Privacy Policy.
By using the Services, you consent to that data collection, use, and retention.
15. Third-Party Services
Project 130 uses external providers such as:
• OpenAI (for the AI coach)
• Stripe (for payments)
• Qoin Network (for payouts)
• Google Analytics (for analytics)
We are not responsible for the actions or security of these third parties but strive to partner only with compliant providers.
16. Disclaimers of Warranties
The Services are provided “as is” and “as available.”
We make no warranties regarding accuracy, reliability, or availability.
17. Limitation of Liability
To the fullest extent permitted by law, we are not liable for:
• Any health or financial outcomes
• Cryptocurrency losses or fluctuations
• Third-party product quality
• Technical interruptions or data loss
Our total liability will never exceed the greater of (a) AUD $100 or (b) the amount you paid for Premium in the preceding 12 months.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of Queensland, Australia, unless otherwise required by mandatory local law.
Disputes shall be resolved exclusively in the courts of Queensland.
19. Changes to These Terms
We may update these Terms from time to time.
Changes take effect when published on our website or app.
Your continued use constitutes acceptance of the new Terms.
20. Founding Supporter Program and Risk Disclosure
Project 130 Pty Ltd (“the Company”) may from time to time invite individuals to participate in its Founding Supporter Program. Participation in this program involves making a voluntary contribution in Qoin or Australian dollars to support the Company’s research and technology work. In return, contributors receive a symbolic digital certificate known as a Founding Supporter Token (LGT). LGTs recognise support only — they are not shares, securities, managed investments, or financial products, and they do not grant any ownership, voting, or dividend rights. All contributions are non-refundable, and the Company offers no guarantee of profit, conversion, or liquidity. Each LGT is recorded on the Company’s internal ledger and is subject to a twelve-month lock-up period from the date of issue. Transfers after that period may occur privately between supporters provided both parties complete the Company’s Transfer & Acknowledgement Form and comply with all applicable laws. Supporters are responsible for their own tax obligations and acknowledge that the entire contribution may be lost. By contributing, supporters confirm that they have read and accepted these Terms and Conditions together with the Company’s Risk Disclosure and release the Company, its directors, and employees from any claim arising from their contribution or the holding or transfer of LGT.
